Grammy-nominated singer Katy Perry has won the legal battle she took back in 2009 against Australian fashion designer Katie Perry. The court ruled her win against the designer in Australia on Thursday, November 21st.
The fashion designer confirmed the results of this feud to The Post after the legal battle took over their common name, which lasted more than a decade.
The trademark battle started in 2009
The singer and the Australian fashion designer had started their legal battle over the common name back in 2009.
However, the Sydney fashion designer’s birth name is Katie Perry, while the Roar singer was born Katheryn Elizabeth Hudson.
The designer spoke about the legal battle
The legal feud ended only this November, with the Grammy-nominated singer winning.
In speaking with The Post, the Australian couturier admitted the effects of this on her, “I have lost everything, including my trademark. As you can imagine I’m devastated.”
Katie had started the fashion brand in 2007
After having started the designer fashion brand under her legal name back in 2007, Katie now feels lost as to what to do next after losing her trademark.
It is certainly a difficult dilemma to be in, especially when you’ve operated under one name for so long.
The designer admitted she felt lost
“My label has been a dream of mine since I was 11 years old and now that dream that I have worked so hard for, since 2006, has been taken away,” she continued.
Before adding, “What do I do now? I will dust myself off and figure out what the next steps are. Perhaps move to somewhere in the world where the name Katie Perry has no meaning.”
The singer had sent a letter
The 40-year-old pop star and her representatives had sent a cease-and-desist letter to the Australian fashion designer, asking her to stop operating her clothing company under the shared name.
Receiving such a letter shocked Katie as she had been operating her brand since 2007.
The singer had lost the battle last year
Last year, the pop star lost the battle over the name after the court decided that she had infringed on the designer’s trademark.
However, the singer didn’t take the loss and filed an appeal, which led to them meeting in court again.
But now the singer has won the feud
Despite having won the case a year earlier, the designer has now lost the trademark to the name.
The whole thing had taken a toll on her, having said that nightmares and insomnia plagued her after the singer’s fans treated her unkindly.
The singer has also previously spoken unkindly
The designer had once recalled a difficult moment in court where she had to read an email between her manager and the singer, where the pop star called her a “d-mb b—ch.”
“Artists are emotional people,” Katy’s manager responded nonchalantly, adding, “That was an emotional response, not directed at Ms.Taylor personally.”
The 2023 win had been one for many businesses
When the brand designer won the legal feud last year, she wrote, “Not only have I fought for myself, but I fought for small businesses in this country.”
Before adding, “Many of them started by women, who can find themselves up against overseas entities who have much more financial power than we do.”
This isn’t the only lawsuit the singer has been in
Although Katy Perry won the feud, battling with the Australian fashion designer isn’t the only time she has taken someone to court.
She had also gone to court with Carl Westcott, a veteran who had agreed to sell his home to her, then backed out on accounts of mental health. The singer won the battle in 2023 in Los Angeles.
