Kevin O'Leary's Wife Had 'Alcohol On Her Breath' The Night Of Fatal Boat Crash

Tragedy struck on Lake Joseph on August 24th as businessman Kevin O'Leary and his wife Linda were driving their boat and collided with a fellow passenger vessel.

The crash resulted in the deaths of 64-year-old Gary Poltash and 48-year-old Suzana Brito.

Both suffered severe head trauma upon impact.

It was initially reported that Linda O'Leary was driving the couple's boat that night.

Now, a new report suggests alcohol was also involved.

CBC News obtained recently unsealed search warrant documents that states Linda had "alcohol on her breath following the fatal boat crash."

"Mrs. O'Leary was administered an alcohol screening device test and registered an alert. She was subsequently served a three-day driver's license suspension," Ontario Provincial Police allege in the documents.

"Mrs. O'Leary claims to have consumed a drink of vodka following the collision and prior to the breath test."

The documents also state that "O'Leary could not remember who handed her the drink of vodka following the collision."

However, Linda's lawyer Brian Greenspan says his client was not intoxicated at the time of the collision.

"This tragic accident had nothing to do with alcohol," Greenspan wrote in an email to CBC News.

He continued, "Linda O'Leary was not impaired; she is a highly experienced boater who was proceeding cautiously with due care and attention. She collided with a totally unlit boat on a moonless night which was invisible to any prudent operator. No one could have avoided the collision."

Linda O'Leary has been charged with careless operation of a vessel under the Canada Shipping Act.

If she is found guilty, she could face a $10,000 fine.
